The Confident Manager Academy Terms of Use
Last updated: 8 September 2026
1. About these Terms
These Terms govern access to and use of The Confident Manager Academy ("the Academy").
The Academy is operated by:
Aspirin Business Solutions Limited, trading as Aspirin Business Solutions ("ABS")
Company number: 05126742
Registered office:
Faulkner House
31 West Street
Wimborne
Dorset
BH21 1JS
United Kingdom
Email: [email protected]
By creating or activating an Academy account, accepting these Terms, or using the Academy after acceptance, the participant agrees to these Terms.
Anyone enrolled by an employer or another organisation must still accept the learner Terms that apply to Academy use.
These Terms apply to the individual participant.
Where an employer or another organisation purchases Academy places, the organisation's commercial arrangements with ABS, including invoicing, participant numbers, substitutions, bespoke services and corporate cancellation arrangements, are governed by the separate agreement between ABS and that organisation.
2. What the Academy is
The Confident Manager Academy is a practical management-development programme designed to help managers build confidence, capability and consistency in everyday people-management situations.
The Academy may include:
online learning content
videos and written resources
tools and worksheets
workplace challenges
reflection activities
community access
live masterclasses or lessons
recordings
surveys and assessments
progress tracking
submitted work
certificates and recognition
optional or additional development tools and services
The Academy is primarily self-directed.
Live sessions and community activity support the learning but do not change the Academy into an individually delivered coaching, consulting, HR or legal service.
3. Academy term and access
Unless the relevant offer or order states otherwise, Academy membership lasts for 12 months from enrolment.
Content may be released progressively during that period. A participant should not expect all 12 months of content to be available immediately after enrolment.
At the end of the membership term:
access to Academy lessons, resources, community areas or live activities may end
the Academy does not automatically renew unless this has been clearly stated and agreed separately
the participant's account may remain available so that certificate or completion information can continue to be accessed
An account remaining available after the membership term does not create an ongoing right to Academy content, community access, masterclasses or future programme updates.
4. Personal accounts
Academy access is provided to a named participant.
Each account is personal and must not be:
shared
transferred
sold
lent to another person
used by several people
used to provide Academy access to people who have not been enrolled
Participants are responsible for keeping their password and login details secure.
Suspected unauthorised access should be reported promptly to [email protected].
5. Employer-sponsored participants
An employer or other organisation may provide ABS with a participant's name, work email address and other information required for enrolment.
Sponsored participants must still comply with these Terms.
The organisation purchasing the place may receive reasonable progress information as described in section 13 and in the Academy Privacy Policy.
A sponsoring organisation does not own the participant's private Academy reflections or community discussions simply because it paid for the place.
6. Fees and payment
The price and payment arrangements that apply to a participant will be shown at purchase or agreed with the organisation purchasing the Academy place.
All applicable VAT or other taxes will be clearly identified where required.
Annual payment
Where an annual payment is selected, the relevant charge covers the agreed Academy term.
Monthly instalments
Where a monthly payment option is offered, it may be a payment plan for a fixed 12-month contract rather than a month-to-month membership.
Where this applies:
the commitment is for the full 12-month term
monthly payments are instalments of that total commitment
stopping use of the Academy does not by itself cancel the remaining payment obligation
the payment plan ends at the end of the agreed term unless another arrangement is expressly agreed
The total commitment and payment structure will be made clear before purchase.
Employer and organisational purchases
Where an organisation purchases Academy places directly from ABS, payment terms are governed by the agreement, proposal, order form or invoice arrangements agreed with that organisation.
7. Consumer cancellation rights
Nothing in these Terms removes statutory consumer rights.
Where a participant purchases directly from ABS as a consumer and a statutory cancellation right applies, the participant will normally have a cancellation period provided by applicable consumer law.
For UK distance contracts this will generally be 14 days from the date the contract is made, subject to the rules applying to services and digital content.
Immediate access
The Academy is designed to provide digital access shortly after purchase.
Where required by law, a consumer requesting digital content or services to begin during the statutory cancellation period will be asked to provide any required express request, consent or acknowledgement.
Where digital content begins to be supplied after the required express consent and acknowledgement, the right to cancel that digital content may be lost to the extent permitted by law.
Where Academy services begin at the consumer's express request during a cancellation period and the consumer later exercises a valid cancellation right, ABS may be entitled to charge a proportionate amount for services already supplied, where permitted by law.
The relevant statutory rights and any required acknowledgement will be presented during the purchase or onboarding process where applicable.
Cancellation requests can be sent to:
A model cancellation form appears at the end of these Terms. Use of that form is not compulsory.
8. Refunds
Except where:
required by law
expressly stated in the relevant offer
agreed by ABS in writing
Academy fees are non-refundable once the applicable cancellation period has ended.
Failure to:
log in
complete learning
attend live sessions
take part in the community
complete challenges
obtain a certificate
does not by itself create a right to a refund.
Where a participant's employer purchased the Academy place, any refund or cancellation rights of the employer are governed by the separate agreement with ABS.
9. Live sessions
The Academy may include live lessons, masterclasses, Q&A sessions or similar events.
ABS will take reasonable steps to provide scheduled live sessions but may need to:
change a date
change a facilitator or speaker
change the delivery format
move a session online
reschedule a session
cancel a particular session where reasonably necessary
Where practical, a replacement session, recording or alternative learning resource may be provided.
Because the Academy is primarily a self-directed programme, a participant who misses a live session is not normally entitled to a refund.
Recordings
Live sessions may be recorded.
Participants will be told when recording is taking place.
A recording may capture a participant's:
display name
image
voice
questions
chat messages
contributions to discussions
Recordings may be made available to other Academy members.
Participants must not disclose confidential or sensitive third-party information during a recorded session.
10. Academy community
The Academy includes a shared learning community.
Participants may be from different employers, sectors, professions and countries.
The community should be practical, respectful and supportive.
Participants must not:
harass, threaten or abuse another member
discriminate against another person
post unlawful or defamatory material
deliberately mislead other members
impersonate another person
post spam or unrelated commercial promotion
upload malicious software
infringe another person's intellectual property
disclose confidential business information without authority
identify colleagues or employees when discussing sensitive workplace situations
share personal employee records or confidential HR information
provide legal, medical or other regulated professional advice while presenting it as authoritative Academy advice
use community information to contact or market to members inappropriately
ABS may moderate, edit, hide or remove content and may restrict or remove community access where reasonably necessary.
11. Confidentiality and workplace examples
The Academy is designed to help participants work through real management situations.
Real examples can be useful, but workplace confidentiality must be protected.
Participants must anonymise examples wherever possible.
Participants must not upload or disclose:
employee health information
grievance records
disciplinary documents
investigation material
confidential performance records
personal information about colleagues
commercially sensitive client information
other information the participant is not authorised to disclose
The Academy community is visible to other Academy members and should not be treated as a confidential one-to-one conversation with ABS.
ABS cannot guarantee that another member will keep voluntarily shared information confidential.
12. Participant submissions
Participants may be invited to submit:
worksheets
challenges
reflections
survey answers
development plans
impact summaries
graduation material
videos
comments
community posts
Participants retain ownership of original content they create.
By submitting content to the Academy, the participant gives ABS a limited, non-exclusive licence to host, store, reproduce and use that content as reasonably necessary to:
operate the Academy
review or assess submissions
provide feedback
record progress
award certificates or recognition
provide community functionality
moderate the Academy
maintain Academy records
Where a participant contributes to a recorded live session, this licence also permits ABS to store and make the relevant recording available as Academy learning content, subject to the Academy Privacy Policy and applicable law.
Marketing use
ABS will not use an identifiable graduation video, photograph, quote, testimonial, submission or case study for external promotional purposes without separate permission from the participant.
13. Information shared with employers
Where an employer or organisation sponsors an Academy place, ABS may provide that organisation with reasonable information about participation and progress.
This may include:
whether the account has been activated
participation
progress through the Academy
modules or activities completed
challenge completion status
attendance at live sessions
completion status
certificate or recognition level
ABS may also provide aggregate Academy information and development themes where relevant.
ABS will not normally provide employers with the detailed content of:
private reflections
submitted exercises
community posts
questions asked in live sessions
free-text survey comments
unless the participant has been clearly told this will happen, permission has been obtained where necessary, or disclosure is required for legal, regulatory or serious safety reasons.
Further details appear in the Academy Privacy Policy.
14. Academy materials and intellectual property
Unless otherwise stated, Academy content is owned by ABS or used by ABS under licence.
This may include:
videos
presentations
written lessons
worksheets
templates
diagrams
models
exercises
graphics
recordings
downloads
assessments
branding
certificates
course structure
Some materials may include intellectual property owned by third parties or licensed methodologies.
Academy membership gives the named participant a limited, personal, non-exclusive, non-transferable right to use the materials for their own learning and professional development.
It does not transfer ownership of those materials.
Without written permission from ABS or the relevant rights holder, participants must not:
copy substantial Academy materials
redistribute resources
sell Academy content
publish Academy materials online
upload Academy content to public file-sharing services
upload Academy content into public AI systems or shared knowledge bases
screen-record or reproduce protected Academy content
use the Academy to train people who do not hold valid Academy access
remove copyright, trade mark or attribution notices
create competing products using Academy materials
An employer may only use Academy resources with employees who do not hold Academy places where this has been separately agreed with ABS.
15. The Confident Manager book and third-party resources
The Academy is connected to concepts and material from The Confident Manager and may refer participants to the book or related resources.
Whether a copy of the book is included in a particular Academy offer will be stated separately.
The Academy may also provide links or access to third-party books, assessments, platforms, tools or services.
Unless expressly stated, access to the Academy does not automatically include every third-party product or separately licensed assessment mentioned within Academy content.
16. Motivational Maps and other assessments
Some Academy cohorts or activities may offer access to Motivational Maps, surveys, development tools, diagnostic tools or related services.
These may:
form part of a particular Academy offer
be available as an optional activity
require separate registration
involve an additional service provider
involve an additional charge
The terms that apply will be made clear where the activity is offered.
Assessment results are intended to support reflection, development and conversation. They should not be treated as the sole basis for recruitment, dismissal, promotion, disciplinary or other significant employment decisions.
17. Artificial intelligence features
The Academy platform or connected services may make AI-assisted features available.
AI-generated or AI-assisted material may contain errors, omissions or inappropriate suggestions.
Participants remain responsible for deciding whether any output is appropriate for their situation.
Participants must not enter confidential employee data, special category information or sensitive third-party information into an AI feature unless specifically authorised to do so.
AI output provided through the Academy is not legal, HR, medical, financial or other regulated professional advice.
18. Certificates, badges and recognition
The Academy may provide recognition including:
Foundation recognition
Graduate status
Graduate with Distinction status
certificates
digital badges
LinkedIn graphics
Eligibility criteria will be published within the Academy and may include:
completion of specified learning
completion of challenges
evidence of practical application
an impact summary
a graduation video or equivalent evidence
Graduate with Distinction may require additional evidence of application or impact.
Certificates confirm Academy participation or completion only.
They are not:
an academic qualification
a regulated professional qualification
a licence to practise
proof that a person is competent in every management situation
a guarantee of performance
Participants may display legitimately earned Academy certificates and badges after completion, including on LinkedIn or professional profiles, provided they are not altered or described in a misleading way.
19. Changes to Academy content
Management practice, technology and the Academy itself will develop over time.
ABS may reasonably update:
lessons
videos
worksheets
exercises
challenge wording
resources
platform features
assessment methods
session dates
speakers
community structure
completion criteria
Changes may be made to improve the Academy, keep material current, respond to participant feedback, address legal or technical requirements, or replace a service that is no longer available.
ABS will take reasonable care not to materially reduce the overall Academy service purchased by an existing participant.
20. Educational guidance and professional advice
The Academy provides management education and development.
It does not provide individual:
legal advice
employment-law advice
formal HR advice
medical advice
mental-health treatment
financial advice
regulatory advice
Academy content dealing with issues such as:
underperformance
grievances
bullying
disciplinary matters
stress
wellbeing
conflict
difficult conversations
is intended to support better management thinking and conversations.
Participants and employers remain responsible for:
following their own policies and procedures
obtaining appropriate professional advice
complying with employment law
making employment decisions
carrying out fair investigations
managing health or safety issues
deciding what action to take in a particular case
21. No guaranteed results
The Academy is designed to support learning, confidence and practical management development.
Results depend on many factors outside ABS's control.
Participation does not guarantee:
improved employee performance
promotion
retention
increased income
improved business performance
successful resolution of a workplace issue
a particular management outcome
achievement of a certificate or Distinction
Participants remain responsible for applying Academy learning appropriately in their own circumstances.
22. Third-party platforms
The Academy is delivered using Thinkific and may use connected services such as video-conferencing, payment, email, assessment or other technology providers.
Use of certain third-party services may also be subject to the provider's own terms and privacy rules.
ABS does not control every aspect of a third-party platform.
Reasonable steps will be taken to select appropriate providers and manage Academy delivery, but continuous or error-free availability cannot be guaranteed.
23. Participant responsibilities
Participants agree to:
provide accurate account information
keep account details reasonably up to date
protect login credentials
use the Academy lawfully
respect other Academy members
protect workplace confidentiality
use Academy materials only as permitted
take responsibility for decisions made after using Academy content
comply with reasonable Academy instructions
tell ABS about suspected security problems or misuse
24. Suspension and removal
ABS may suspend or remove Academy access where reasonably necessary because of:
serious or repeated breach of these Terms
account sharing
intellectual-property misuse
unlawful conduct
harassment or discrimination
serious community misconduct
attempts to compromise Academy security
misuse of other members' information
non-payment by the responsible purchaser
conduct that creates a material risk to ABS, the Academy or other members
Where appropriate, ABS may first provide a warning or an opportunity to correct the issue.
Serious breaches may result in immediate suspension.
Fees are not normally refundable following suspension or removal for breach, subject always to statutory rights.
25. Platform availability and events outside reasonable control
Online platforms occasionally experience:
maintenance
technical faults
internet outages
third-party failures
service interruptions
security incidents
ABS will take reasonable steps to maintain Academy access and deal with problems within its control.
ABS will not be responsible for a failure or delay caused by events outside reasonable control, provided reasonable steps are taken to limit the impact.
Where a significant Academy feature becomes permanently unavailable, ABS may replace it with a reasonably equivalent feature or delivery method.
26. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:
death or personal injury caused by negligence
fraud or fraudulent misrepresentation
any other liability that cannot legally be excluded
Consumers
Where the participant is a consumer, statutory consumer rights remain unaffected.
ABS is responsible for foreseeable loss or damage caused by a breach of these Terms or a failure to use reasonable care and skill.
ABS is not responsible for loss or damage that was not reasonably foreseeable.
The Academy is designed for management and professional development. To the extent permitted by law, ABS is not responsible to a consumer for commercial or business losses arising from use of the Academy.
Non-consumers and business use
Where the participant is not acting as a consumer, and subject to the liabilities that cannot legally be excluded:
ABS will not be liable for indirect or consequential loss
ABS will not be liable for loss of profit, revenue, business opportunity, goodwill or anticipated savings
ABS's total aggregate liability arising from the relevant Academy place will not exceed the amount paid or payable for that participant's Academy place for the relevant term
Nothing in this section removes any protection that the law says must apply.
27. Privacy and personal information
Personal information is handled in accordance with The Confident Manager Academy Privacy Policy.
Participants must read that Privacy Policy before using the Academy.
Employer-sponsored participants should pay particular attention to the sections explaining employer-provided information and progress reporting.
28. Changes to these Terms
ABS may update these Terms where reasonably necessary because of:
changes in law
regulatory guidance
changes to the Academy
security requirements
technology changes
changes to third-party services
The current version will be available through the Academy platform.
Where a change materially affects an existing participant's rights during an already purchased Academy term, reasonable notice will be provided.
Material changes will not be applied retrospectively in a way that unfairly removes rights already acquired, unless required by law.
29. Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
30. No waiver
A delay by ABS in enforcing a right under these Terms does not mean that right has been given up.
31. Governing law and courts
These Terms are governed by the laws of England and Wales.
Where the participant is not a consumer, the courts of England and Wales will have jurisdiction over disputes arising from these Terms.
Where the participant is a consumer, nothing in this section removes any mandatory right to rely on the consumer law of their home country or to bring proceedings in another court where applicable law gives that right.
32. Complaints and contact
Questions about the Academy, complaints or cancellation requests should be sent to:
